PLEASE READ THESE TERMS AND CONDITIONS ("T&C") CAREFULLY BEFORE USING THE SERVICES OF AIPhotos.cc. THESE TERMS GOVERN THE LEGAL RELATIONSHIP BETWEEN YOU AND HANSEATIC BITS UG (LIMITED LIABILITY) & CO. KG AS THE OPERATOR OF THIS WEBSITE.

1. Scope

The following terms and conditions apply to the use of the website AIPhotos.cc as well as all related offers, features, content, and services.

2. Services of AIPhotos.cc

AIPhotos.cc enables users to generate, download, and use images created with the help of AI technology.

3. User Obligations

Use of the service is only permitted for persons who are at least 18 years old or have reached the legally required minimum age in their country.

You warrant that you either provide your own images or have the explicit written consent of the persons depicted, especially when creating AI images based on photos of third parties.

The following content is prohibited to upload, generate, or share:

• content that violates applicable law,
• content inciting hatred, violence, or discrimination,
• sexual or pornographic depictions, especially involving minors,
• content that is defamatory, offensive, misleading, or fraudulent,
• content violating the privacy of third parties,
• information or content glorifying terrorism or extremist groups.

4. Copyright and Reporting of Infringements

Hanseatic Bits UG (limited liability) & Co. KG respects intellectual property rights. If you believe that an image created by the service infringes your rights, you may notify us in accordance with the German Copyright Act for Service Providers (UrhDaG).

A valid notice must include the following:

• Your contact information (name, address, phone number, email),
• a description of the affected work,
• the exact link (URL) of the disputed content,
• a sworn declaration that you are the rights holder or authorized to act on behalf of the rights holder.

5. Changes to the Terms and Conditions

We reserve the right to change these terms and conditions at any time. Changes become effective as soon as they are published on the website. It is your responsibility to review the T&C regularly.

6. Usage Rights and Licenses

You receive a non-exclusive, non-transferable, revocable license to use the service for private or commercial purposes.

You retain ownership of the images ("assets") you generate. However, you grant Hanseatic Bits UG (limited liability) & Co. KG the right to use your input texts (prompts), uploaded content, and generated images free of charge, worldwide, permanently, and sublicensable for the purpose of improving and providing the services.

7. Prices and Payment

AIPhotos.cc offers paid services including subscriptions that renew monthly or annually. Cancellation can be made at any time via the website. Already paid amounts will not be refunded. We reserve the right to change prices.

8. Termination of Contract

We may terminate your access to the service with immediate effect if you violate these terms and conditions.

9. Indemnification

You agree to indemnify Hanseatic Bits UG (limited liability) & Co. KG, its employees, and partners from all claims by third parties arising from your use of the website or any breach of these T&C.

10. Limitation of Liability

The liability of Hanseatic Bits UG (limited liability) & Co. KG is limited to intent and gross negligence. For simple negligence, we are only liable for breach of essential contractual obligations (cardinal obligations), with liability limited to typical foreseeable damages.

The above limitations of liability do not apply to damages resulting from injury to life, body, or health, as well as claims under the Product Liability Act.

11. Applicable Law and Jurisdiction

German law applies. Jurisdiction, where legally permissible, is Haren (Ems), Germany.

12. Final Provisions

If individual provisions of these T&C are wholly or partially invalid, the validity of the remaining provisions remains unaffected.
